By creating an account, subscribing to, or using Maabara Online, you agree to be bound by these Terms of Service, our Privacy Policy, and Cookie Policy.

You confirm that you have the legal capacity and authority to enter into these terms and, where applicable, to bind your organization to these obligations.

2. Definitions

For purposes of these Terms, the following definitions apply:

• Service: Refers to the Maabara Online platform and all related services provided through the platform.
• Customer Data: Refers to any information, files, content, or data that you upload, submit, or generate while using the Service.
• Maabara Online: Refers to the provider and operator of the Service.

3. User Obligations

When using Maabara Online, you agree to:

• Provide accurate, complete, and up-to-date information
• Keep your account credentials confidential and secure
• Enable multi-factor authentication (MFA) where available
• Use the Service only for lawful and authorized purposes

4. Acceptable Use Policy

You agree not to use Maabara Online for activities that may compromise the security, integrity, or legality of the Service.

Prohibited activities include:

• Engaging in illegal activities
• Distributing malware, viruses, or harmful content
• Violating intellectual property rights or other third-party rights
• Attempting unauthorized access to systems or accounts

5. Data Ownership & Processing

You retain full ownership rights over your Customer Data. Maabara Online does not claim ownership of the information you upload or generate through the Service.

We process Customer Data only based on your instructions and in compliance with applicable data protection laws, including the Kenya Data Protection Act, 2019 and the GDPR where applicable.

6. Subscriptions & Payments

Subscriptions are billed in advance according to the selected plan and payment terms.

All fees paid are non-refundable except where refunds are required under applicable laws or regulations.

7. Governing Law

These Terms of Service shall be governed and interpreted in accordance with the laws of the Republic of Kenya.

Any disputes arising from these Terms shall be handled in accordance with the applicable legal processes within Kenya.
